Terms and Conditions

These Terms and Conditions apply to the sale of products by Made by the Forge Ltd, trading as Made by the Forge and Nigel Tyas Ironwork.

By using our websites or placing an order, you confirm that you accept these terms and agree to comply with them. If you do not agree with these terms, please do not use our websites.

Use of our website

You may use our websites for browsing and purchasing our products.

You may print or download content for personal use only and must not reproduce, distribute or modify any content without our written permission.

We take care to ensure information is accurate; however product specifications, finishes, availability and prices may change without notice.

These terms are governed by English law and subject to the jurisdiction of the courts of England and Wales.

Purchase of products

How the contract is formed

After placing an order you will receive an email acknowledging receipt.

A contract between you and us is formed only when full payment has been received and confirmed by us.

Acceptance of orders

We reserve the right to refuse or cancel any order where:

  • payment is unauthorised or suspected fraudulent
  • products are unavailable
  • pricing or description errors occur

Bespoke and made-to-measure products

Many of our products are handmade to order.

Full payment is required before production begins.

Once payment has been received and production has commenced, bespoke or made-to-measure orders cannot be cancelled, returned or refunded.

Bespoke products include:

  • curtain poles cut to length
  • made-to-measure ironwork
  • any item manufactured to a customer's measurements or specification

These products cannot be resold once production has begun.

By placing an order for a bespoke or made-to-measure product, you acknowledge that the item is manufactured specifically to your measurements or specification and cannot be resold once production has begun.

Designs and specifications are agreed before manufacture.

You are responsible for ensuring that all measurements supplied are accurate. We guarantee the fit of products based on the measurements supplied, but we cannot accept responsibility for measurement errors.

As each item is individually handcrafted, small variations in size, finish, hammer marks and natural characteristics of handmade ironwork are part of the product and do not constitute faults.

Remedies will only be offered where a product is genuinely defective, damaged in transit, or materially different from the agreed specification.

Returns

Returns are accepted only on standard off-the-shelf items.

If you wish to cancel an order for a standard item purchased online, you must notify us within 14 days of delivery.

Once cancellation has been notified, the item must be returned within 14 days.

Returned items must be:

  • unused
  • in perfect condition
  • in their original packaging

Returns are at the customer's cost unless the product is faulty or incorrectly supplied.

Returned items are inspected on receipt. If goods are returned in a condition that reduces their resale value, we reserve the right to deduct an appropriate amount from any refund to reflect the loss in value.

Items returned in a condition that makes them unsellable will not be refunded.

Bespoke, made-to-measure or cut-to-length items are non-returnable unless genuinely defective or damaged in transit.

Original packaging should be used when returning long items such as curtain poles to ensure safe transport.

This does not affect your statutory rights under UK consumer law.

Installation and contractors

Customers must check all goods upon delivery before arranging installation.

Made by the Forge Ltd strongly advises customers not to book installers or contractors until goods have been received and confirmed as suitable.

We accept no liability for costs incurred by third-party contractors or services, including installers, couriers, decorators, builders, curtain fitters or any other related expenses.

Customers are responsible for checking that products are correct and suitable before installation or alteration.

Delivery

Standard UK delivery is made by courier or Royal Mail and may require a signature.

Please ensure someone is available to accept delivery and that access is suitable.

Redelivery caused by absence or access issues may incur additional charges.

Inspect goods on delivery and report any damage or shortages within 72 hours.

Product descriptions and conformity

All products are individually handcrafted and small variations in size, finish or form may occur.

Colours shown online may vary due to lighting or screen differences.

Products are intended for interior use unless stated otherwise.

Standard fixings are supplied; however some surfaces may require specialist fixings appropriate to the installation surface.

Customer expectations

Customers are responsible for ensuring that products ordered are suitable for their intended use, space and aesthetic requirements.

As our products are handcrafted, variations in finish, colour tone, hammer marks and other natural characteristics of handmade ironwork are part of the design and should be expected.

Customers are encouraged to review product descriptions, photographs and specifications carefully before ordering, and to contact us if further clarification is required.

Guarantee

All Made by the Forge and Nigel Tyas products carry a lifetime guarantee against manufacturing defects.

This guarantee does not cover:

  • normal wear and tear
  • misuse
  • poor maintenance
  • incorrect installation
  • exposure to excessive moisture or outdoor conditions (unless specified)

If a defect occurs under normal use we will repair or replace the item at our discretion.

Price and payment

All prices include VAT at the applicable rate.

Prices may change without notice but will not affect orders already confirmed.

Payment must be made in full before products are manufactured or dispatched.

Payment may be made by debit card, credit card, or other payment methods offered at checkout.

Risk and title

Products become your responsibility upon delivery.

Ownership of goods transfers only once full payment has been received.

Limitation of liability

Our liability for any claim relating to the supply of our products, whether arising in contract, negligence or otherwise, will not exceed the purchase price of the product supplied.

We accept no liability for indirect or consequential losses including installation costs, contractor charges, decorator costs or similar expenses.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence or for any liability that cannot be excluded under UK law.

Force majeure

We are not liable for delays or failure to perform obligations where such delay or failure results from events beyond our reasonable control, including transport disruption, extreme weather, industrial disputes, supply chain failure or other unforeseen circumstances.

We aim to acknowledge complaints within one working day and resolve issues promptly.

General terms

Communications may be electronic via email or website notices.

Failure to enforce any right does not constitute a waiver of that right.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

These terms represent the entire agreement between you and Made by the Forge Ltd regarding the purchase of products.

No third party has rights under these terms.
